These Terms and Conditions are provided in English for convenience and informational purposes. In the event of any discrepancy, inconsistency, or conflict between the English version and the German version, the German version shall prevail and be legally binding.

1 Scope

(1) These Terms and Conditions (hereinafter referred to as “Terms”) of Saskia Kaufmann (hereinafter referred to as the “Seller”) shall apply to all contracts for the delivery of goods concluded by consumers (hereinafter referred to as the “Customer”) through the Seller’s online shop.
(2) The Seller’s offer is directed exclusively to consumers within the meaning of Section 13 of the German Civil Code (BGB).
(3) A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.
(4) Any terms and conditions of the Customer shall not apply unless expressly agreed otherwise.

2 Conclusion of Contract

(1) The product descriptions provided in the Seller's online shop do not constitute binding offers by the Seller but serve as an invitation for the Customer to submit a binding offer.
(2) The Customer may submit an offer using the online order form integrated into the online shop. After placing the selected goods in the shopping cart, completing the checkout process, and entering the required information, the Customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping cart by clicking the button that completes the order process.
(3) The Seller accepts the Customer's offer by sending an order confirmation in text form (e.g. by email). The purchase contract is concluded upon receipt of the order confirmation by the Customer.
(4) Before submitting the order, the Customer may correct any input at any time using the standard input and correction functions available during the ordering process. In addition, all order details are displayed once again in an order summary before the order is submitted.
(5) The contract language is German or English. The contract is concluded in the language selected by the Customer during the ordering process.

3 Storage of Contract Text

(1) The Seller stores the contract text after conclusion of the contract.
(2) The Customer may access, save, and print these Terms and Conditions via the website before placing an order. The order data will be provided to the Customer in text form (e.g., by email) after conclusion of the contract.
(3) After completion of the ordering process, the contract text is no longer accessible via the website.

4 Prices and Payment Conditions

(1) All prices stated in the online shop are final prices and include all price components.
(2) In accordance with Section 19 of the German Value Added Tax Act (UStG), no VAT is charged or shown (small business regulation).
(3) In addition to the stated prices, shipping costs may apply. The amount of the shipping costs depends on the delivery destination and is displayed to the Customer during the ordering process before the order is submitted. Information on the applicable shipping zones and shipping conditions can be found in the separate Shipping Information section of the online shop. 
(4) The available payment methods are displayed during the ordering process.
(5) Payment processing is carried out via the payment service provider selected by the Customer. The terms and conditions of the respective payment service provider shall apply in addition.

5 Delivery and Shipping

(1) Delivery shall be made to the delivery address specified by the Customer.
(2) Deliveries are made to the countries available for selection during the ordering process.
(3) Delivery times are specified in the respective product description or during the ordering process.
(4) The Customer is responsible for ensuring that the delivery address provided is accurate and complete. Any additional costs arising from incorrect or incomplete address information or from failed delivery for reasons attributable to the Customer shall be borne by the Customer.
(5) If an ordered item is exceptionally unavailable, the Customer shall be informed without undue delay. Any payments already made shall be refunded without undue delay.
(6) For deliveries to countries outside the European Union, additional costs may arise that are beyond the Seller's control and must be borne by the Customer. These may include, in particular, import duties (e.g. customs duties), taxes (e.g. import VAT), and other official charges. Such costs must be paid by the Customer directly to the competent authorities or the shipping service provider upon importation of the goods or upon delivery. 
(7) Delivery periods shall be extended appropriately in the event of force majeure or other events beyond the Seller’s control (e.g., strikes, governmental measures, natural disasters, pandemics, or comparable events). The Customer shall be informed without undue delay of any significant delays.
(8) In the case of consumers, the risk of accidental loss or accidental deterioration of the goods passes to the Customer only upon delivery of the goods to the Customer.
(9) If goods are delivered with obvious transport damage, the Customer is requested to report such damage to the carrier as soon as possible and to inform the Seller accordingly. Failure to do so shall not affect the Customer’s statutory rights, in particular warranty rights.

6 Retention of Title

The delivered goods shall remain the property of the Seller until full payment of the purchase price has been received.

7 Right of Cancellation/Withdrawal

Consumers are entitled to the statutory right of cancellation/withdrawal.
Details of the right of cancellation/withdrawal can be found in the separate Cancellation Policy and the Model Cancellation Form provided on the Seller’s website.

8 Statutory Warranty Rights

The statutory provisions governing liability for defects shall apply.

9 Product Representation and Colour Variations

(1) Product images displayed in the online shop are provided for illustrative purposes only.
(2) Due to differing screen, monitor, and device settings, minor colour variations may occur between the product images displayed in the online shop and the actual product.
(3) Minor colour variations resulting from technical characteristics of screen displays or the printing process shall not constitute a defect in the goods, provided that such variations are reasonable for the Customer.

10 Copyright

(1) All art prints, motifs, photographs, illustrations, designs, and other content offered through the online shop are protected by copyright.
(2) The purchase of an art print transfers ownership only of the physical print purchased.
(3) No rights of use, reproduction, publication, distribution, or exploitation of the motifs are transferred to the Customer.
(4) Any reproduction, digitisation, modification, publication, or other use of the protected content beyond the limits permitted by law requires the Seller’s prior express consent.

11 Liability

(1) The Seller shall be liable without limitation for damages arising from injury to life, body, or health, as well as for damages caused intentionally or by gross negligence.
(2) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), liability shall be limited to the foreseeable damage typical for the contract. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the Customer may regularly rely.
(3) In all other respects, the Seller shall be liable in accordance with the applicable statutory provisions.
(4) Liability under the German Product Liability Act (Produkthaftungsgesetz) shall remain unaffected.

12 Applicable Law and Dispute Resolution

(1) The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) In relation to consumers, this choice of law shall apply only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
(3) The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
